Terms and Conditions

 

  1. The online voting campaign to which these Terms and Conditions apply (hereinafter referred to as the “Voting”) is for the purposes of the Hometown Heroes web series, and produced by Zendyll Collective Pte Ltd (hereinafter referred to as “Zendyll”). These Terms and Conditions shall apply to all stages of the Voting.
  2. All participants of the Voting must follow the procedures provided to them, including all instructions set out in this website, over the air or by any publicity materials provided by Hometown Heroes at any time and from time to time, including all instructions shown on screen during the programmes or otherwise.
  3. Unless otherwise stated in the Voting campaign itself, the Voting is open only to all voters with a valid Zendyll account. The participant(s) warrant to Zendyll that they have the legal capacity to participate in the Voting in accordance with these Terms and Conditions.
  4. You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, offer for sale, or use (except as explicitly authorized in these Terms and Conditions) content and information contained on or obtained from or through Hometown Heroes. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections on the Hometown Heroes website; use any robot, spider, scraper or other automated means to access the Hometown Heroes website; or use any data mining, data gathering or extraction method. We may terminate or restrict your use of our website if you violate these Terms and Conditions or are engaged in illegal or fraudulent use of the service.
  5. Your personal data will be collected, used, disclosed and/or processed by Zendyll for the following purposes:
    • For Zendyll or its designated representatives or business partners to provide goods and services to you or parties designated by you and matters ancillary thereto.
    • For verification and record of your personal particulars including comparing it with information from other sources and using the information to communicate with you.
    • For research and analysis, including surveys and polls.
    • To send you notices, information, promotions and updates including marketing and advertising materials in relation to Zendyll’s goods and services and those of third party organizations selected by Zendyll.
    • To comply with any request from any third party or any order of court or directive from authorities investigating any alleged offence or misconduct or for the purposes of taking legal action against any you.
  6. By participating in the Voting, you:
    • consent to Zendyll collecting, using, disclosing and/or processing your personal data for the purposes as described above;
    • consent to Zendyll transferring your personal data out of Singapore to Zendyll’s third party service providers or agents for the purposes as described above.

  8. Each participant irrevocably releases Zendyll from and against any and all claims, suits, liabilities, or damages which such person may have in connection with his or her particulars or information, being (i) used by Zendyll (or any third party which Zendyll has released the particulars/information to) in any manner or format; or (ii) disclosed or otherwise provided by Zendyll to any third party as provided herein.
  9. Each participant shall bear each of their own costs and expenses incurred and/or arising from their participation in the Voting, including (without limitation), telecommunications, network, SMS and all such other charges and out-of-pocket expenses as may be incurred by each participant during or in connection with the Voting and no reimbursement may be sought from Zendyll.
  10. The selection and number of judges, and the manner in which the Voting is conducted or judged, at each stage of the Voting shall be at Zendyll’s sole and absolute discretion and the judges’ and/or Zendyll’s decision at all stages of the Voting is final. No enquiries, appeals, verbal or written, shall be entertained. The participants shall accept and abide by any and all decisions made by Zendyll and/or the judges concerning, without limitation, the rules of the participation, the rules, procedures and regulations of the Voting, the puzzles set on the Voting, interviews with the participants (if any), the award of prizes and any other matters relating to the Voting including the production thereof.
  11. Zendyll reserves the right to amend or vary any of these Terms and Conditions and the Voting without prior notice to any participant. By continuing to participate in the Voting you will be deemed to have accepted the amended and/or varied terms and conditions, which will be posted on this website. Zendyll further reserves the right, without any liability to any participant(s), to disqualify any participant(s) from the Voting at any time at its discretion.
  12. Zendyll shall be under no liability whatsoever to the participant(s) or the participant(s)’ personal representatives, in respect of any loss, damage suffered by the participant(s) arising from or pursuant to the Voting or for any loss, damage or injury to life or property sustained by the participant(s) at any stage of the Voting and during production thereof, unless such loss, damage or injury is caused by Zendyll’s gross and willful negligence.
  13. The participant shall indemnify and keep Zendyll and its related/affiliated companies, officers, agents and employees (the “Indemnified Parties”) fully indemnified against any and all loss, damage, claims and costs (including legal costs on a full indemnity basis) suffered and/or incurred by any of the Indemnified Parties as a result of the participant’s breach of any of these Terms and Conditions.
  14. By his/her participation, the participant accepts to be bound by these Terms and Conditions.
  15. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore.
  16. No third party shall have any rights under the Contracts (Rights of Third Party) Act of the Republic of Singapore.
  17. If any provision or provisions of these Terms and Conditions shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.
